Copyright Policy (DMCA)

1. Overview

R.A.C.E. respects the intellectual property rights of others and expects users of the platform to do the same. This policy explains how to notify us of a claimed copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512), what we do when we receive a valid notification, how to submit a counter-notice if your content was removed by mistake, and our policy toward repeat infringers.

3. How to Submit a Notification of Claimed Infringement

If you believe content on R.A.C.E. infringes your copyright, use the copyright notice form. It asks for each element below, records your notice with a reference the moment it is received, and emails you whether it was forwarded to the account the material belongs to. You may instead send a written notification to copyright@race.social. Either way it must include all of the following, as required by 17 U.S.C. § 512(c)(3)(A):

• A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material claimed to be infringing, with information reasonably sufficient to let us locate it — in practice, the direct URL(s) on race.social.
• Your address, telephone number, and email address.
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

4. What R.A.C.E. Does on Receipt

On receiving a notification that substantially complies with the requirements above, R.A.C.E. will remove or disable access to the identified material expeditiously and notify the user who posted it.

If your content was removed and you believe it was removed by mistake or misidentification, you may submit a counter-notice to copyright@race.social that includes all of the following, as required by 17 U.S.C. § 512(g)(3):

• Your physical or electronic signature.
• Identification of the material that was removed and its location on the platform before it was removed.
• A statement, made under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, any judicial district in which R.A.C.E. may be found), and that you will accept service of process from the person who submitted the original notification.

6. Restoration Timeline

On receiving a compliant counter-notice, R.A.C.E. will forward it to the original complainant and tell them the material will be restored in 10 business days. Unless the complainant notifies us that they have filed a court action seeking to restrain the user from engaging in infringing activity relating to the material, we will restore the material not less than 10 and not more than 14 business days after receiving the counter-notice.

7. Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, is liable for damages — including costs and attorneys' fees — incurred as a result of R.A.C.E. relying on that misrepresentation. Do not submit a notification or counter-notice unless you believe, in good faith, that it is accurate.

8. Repeat Infringer Policy

R.A.C.E. terminates, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright, consistent with 17 U.S.C. § 512(i)(1)(A). This policy is described further in the Terms of Service, User Content section.
